LISW Breakfast – Relflections on the blocking and trapping of ships in the Black Sea

7KBW will be hosting a breakfast event for London International Shipping Week (LISW)  on Tuesday 16 September.

Titled Reflections on the blocking and trapping of ships in the Black Sea, the event will be chaired by Mr Justice Bright who will lead the discussion with several authors of the recent “Carver on Charterparties” : Stephen Hofmeyr KC, Simon Kerr and Richard Sarll.  They will examine a number of the implications of war for charterparties following the detention or delay of ships and their cargo at Black Sea ports, and in the wake of Houthi missile strikes.

Particular topics of discussion will include:

  • The Polar in the Supreme Court:-   When will charterparty war risks clauses constitute a complete contractual code?   What has been the impact on transits of the Red Sea?
  • The doctrine of frustration in Black Sea trapping cases:-   When will frustration intervene; how and by whom are owners compensated for services after the discharge of contract?
  • The evaluation of damages in cases of vessel detention or delay: when will a simple approach of assessing damages (at a pre-agreed or “market” rate) give way to broader factors in order to prevent under- or overcompensation?
