The claim was successfully defended on all levels and is an important authority on the limitations on the extent of a broker’s duties, as well as the circumstances in which a finding of contributory negligence might be made in an action against an insurance broker. It also resolves the vexed question of whether credit must be given for depreciation savings in a claim under a business interruption policy.
