“RECENT CASES IN THE LAW OF MARINE INSURANCE” – LSLC seminar in collaboration with 7KBW

At 6pm on Wednesday 10 May 2023 at the IDRC, Jawdat Khurshid KC will join a distinguished panel to discuss recent marine insurance cases, chaired by Lord Mance. 

The seminar will be of interest to all stakeholders in the marine insurance claims community.  Attendance is not restricted to members of the London Shipping Law Centre.  Non-members are encouraged to email  shipping@shippinglbc.co.uk regarding attendance.

Points of discussion will include:

  • The requirements for insurable interest following the Court of Appeal’s decision in Quadra Commodities SA v XL Insurance Company SE [2023] EWCA 432.
  • The status of warranties and terms descriptive of the risk under Insurance Act 2015, with a consideration of PT Adidaya Energy Mandiri v MS First Capital Insurance Ltd [2023] Lloyd’s Rep. IR 143, a decision of Sir Jeremy Cooke sitting in the Singapore International Commercial Court. Particular Issues: constructive total loss, notice of abandonment, waiver of a claim for a constructive total loss and sue and labour.
  • Coverage under MII policies following Piraeus Bank AE v Antares Underwriting Ltd [2022] 2 Lloyd’s Rep 1 .

The other speakers on the panel will be Professor Professor Özlem Gürses of King’s College London jobs and Mr Peter Mellett of Bankserve.
