Stephen Phillips KC and James Goudkamp secure US$40m judgment in Lakatamia Shipping Co Ltd v Tseng [2023] EWHC 3023 (Comm).

On the 27 November 2023, Stephen Phillips KC and James Goudkamp obtained an approximately US$40m judgment (with interest and costs) on behalf of the claimant in Lakatamia Shipping Co Ltd v Tseng [2023] EWHC 3023 (Comm).  Following a trial, Mr. Justice Foxton held that the defendant, a Ms Tseng Yu Tsia, had unlawfully conspired to conceal money from the claimant that had been yielded by the sale of two villas in Monaco and a private aeroplane.  Among other points of note in his reasons, Mr Justice Foxton confirmed the existence of the Marex tort (the tort of intentionally and knowingly inducing a violation of rights in a judgment debt), which has now established a firm foothold in the law.

The judgment is the latest installment in the long-running dispute between the claimant and members of the Su family and their associates, who formerly owned and operated a substantial shipping business headquartered in Taiwan.
