Stephen Kenny acted for the plaintiff, Karaganda Ltd. This letter of credit case concerned the requirement under UCP 500 for tender of original documents. The Court of Appeal held (notwithstanding the terms of Art. 20(b) of UCP 500) that a document created on a word-processor, printed on a laser-printer, but not “marked as original” was nevertheless an original (cf Glencore v Bank of China [1996] 1 Lloyd’s Rep. 135). A Petition to the House of Lords was refused.
