Following her Ladyship’s judgment in June 2019 ( EWHC 1558 (Comm)), Mrs Justice Cockerill has found that the two former Scotland Yard police detectives and private investigators are in contempt of Court for failing to deliver up all confidential documents obtained by them during the course of their internal investigation at FBME Bank, and for failing to provide sufficiently detailed affidavits explaining the circumstances of the unlawful dissemination of confidential information by them to third parties.
Applying Re Asbestos Insurance Cases  1 WLR 331 and Tajik Aluminium Plant v Hydro  EWCA Civ 1218 in the context of letters of request, Mrs Justice Cockerill’s original order had required the defendants to provide copies of all communications evidencing each and every disclosure. The particulars of the defendants’ non-compliance are set out at paragraphs 15 – 30 of the Judgment.
Mrs Justice Cockerill has afforded the defendants 28 days within which to purge that contempt or face an application for committal.
