Josephine Higgs KC has recently produced a practice note with LexisNexis on Covid-19 business interruption insurance claims after the FCA Test Case.
The FCA Test Case was intended to clarify whether business interruption insurance policies covered losses related to the Covid-19 pandemic and associated restrictions; however, disputes have continued to arise, particularly in relation to causation, aggregation and quantum. Over the last 3 years, various claims have been reached the English Commercial Court and the Court of Appeal or have been determined in public arbitration awards. Josephine Higgs KC was involved in several of those claims and has produced a practice note in partnership with LexisNexis regarding Covid-19 business interruption insurance claims after the FCA Test Case.
