The Republic of Bulgaria has successfully defended an ICSID arbitration claim brought by a Czech utility company under the Energy Charter Treaty. In an award issued last week, the tribunal found that Bulgaria’s actions in the country’s electricity market did not breach the standards for the protection of foreign investments under the ECT.  

Alice Osman acted for Bulgaria and conducted oral advocacy at the merits hearing in her previous role as a Senior Associate at Arnold & Porter.
