David Allen KC appeared for the successful Eletson Corporation and Eletson Gas LLC parties in the BVI Commercial Court successfully defending contempt of Court proceedings seeking sequestration of assets, fines and other remedies. The Court considered standard Freezing Order undertakings and whether there had been a breach of those undertakings and Contempt of Court when Eletson’s New York attorneys disclosed information given in the WFO proceedings in related New York proceedings. The Court held that there had been no breach of Eletson’s undertakings when disclosing that information in related proceedings and no contempt of Court. The case of Chedington Evens Limited & others v Nihal Brake & others [2022] EWHC 2880 was considered and applied.
